Terms and Conditions

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://delinuts.co.uk website (the “Service”) operated by Delinuts Ltd (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Delinuts.co.uk is the trading name of Delinuts Ltd. (Registered in England and Wales No 12601318), VAT Reg 350 3557 16. 

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Orders

When you place an order we will aim to ship your order within 2 business days. Despite the fact that we control our stock constantly, there is always a chance of running out of stock and not be able to ship part or your whole order. If this happens, you have the following options:

  • You wait until we have in stock all your shipment and we ship it all in one.
  • We can ship the part of your shipment we have at that time and when we restock we will ship the rest of your order on our cost.
  • We can ship the part of your order we have, and refund as a voucher the amount of the products we do not have in stock including the cost, if there is any, due to a change of shipping category, with validity at least 6 months.
  • You can cancel your order and get a full refund. 

In the unfortunate event you would like to cancel, you can do it, with no cancellation fees while your order is still in process. If your order has been shipped, and you want to cancel it, you can still do it, however you will be charged with the shipping cost and you will only get a refund of the cost of the products, after any discount that may have been applied during your order.

Coupons

  • Coupons must be used until the date stated on the email you received the coupon with, or the date mentioned on paper coupon you received with your order.
  • Expired or used coupons are not valid and we can not accept them under no circumstances. 
  • You are allowed to use only one coupon per order.

Refunds & Returns

You are entitled to a 14 days refund from the day you have received the products if:

  • the products are expired.
  • the packaging is damaged or not sealed.
  • the products never arrived or you received the wrong products.

Proof with pictures is required.

The refund could be

  • A coupon issued by us and valid for at least 3 months which will be equal to the value of the defective product including a 10% surcharge. For example, if you had an order of total amount of £100 and a product of value of £20 was defected, the coupon value will be £20+10% = £22.
  • Refund of the full amount of money for the defective product, excluding the shipping if the rest of the products are in good condition.
  • Refund of the full amount of money including any shipping cost if all the products were defected.

We do our best to make sure, all products which leave our premises are in perfect condition, nevertheless it is your responsibility to ensure that all the goods received are in perfect order (eg. expired, missing, damaged, smelly, stale). If you start using the products with any of the mentioned issues we are not responsible for the damage these issues may cause.

You are also entitled for a refund if a product has less than 2 months of Best Before End date.

We will not refund or accept returns of any products that are opened or damaged by you.

Shipping

We ship our products in UK and Northern Ireland only. During the checkout you will be asked to enter your postcode so the shipping cost can be automatically calculated and added in your total. The shipping cost is based on the weight of your shipment. Your shipment weight is based on the products you have in your basket. Some products may be much heavier than the weight of the product you choose. For example, 900g of Thyme Honey has a shipping weight of 1,5kg because its package is a jar made of glass. 

The shipping weight is calculated as follows:

  • For package weight up to 1,8kg the cost is £5,8.
  • For package weight from 1,9kg up to 4,8kg the cost is £7,6.
  • For package weight from 4,9kg up to 9,8kg the cost is £8,9.
  • For package weight from 9,9kg up to 14,8kg the cost is £13,2.
  • For package weight from 14,9kg up to 19,8kg the cost is £22,8.
  • For package weight from 19,9kg up to 24,8kg the cost is £27,2.
  • For package weight from 24,9kg up to 29,9kg the cost is £30,8.
  • For package weight above 30kg the shipping will be free of charge.

For orders with a total amount above £45 Free Shipping is applied. The total amount has to be above £45 on the total final price, after any coupon that may have been applied.

Our products are packed in an environment which also handles

  • nuts
  • peanuts
  • sesame
  • seeds
  • gluten
  • soy
  • eggs
  • milk
  • sulphured fruits.

Food Safety

Food safety and hygiene is our top priority. We would also like to assure you that all goods are stored and handled in a professional and hygienic manner at all times.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Delinuts Ltd and its licensors.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Delinuts Ltd.

Delinuts Ltd has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Delinuts Ltd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Payments

We accept all major credit/debit cards with Stripe and you can also pay with PayPal.

We store only the minimum amount of information from you necessary to make a transaction. We never store your credit/debit card details. All credit/debit card payments are handled by our processor Stripe. Additionally, we use PayPal only for users who have an account with PayPal so they can pay without having to enter their credit card/debit card details.

When you save your credit/debit cards for future payments you give permission to Delinuts Ltd to:

  • charge your card without having to re-enter your credit/debit card details every time you make a purchase.
  • charge your card on your behalf when placing orders by email and want to avoid us contacting you to provide your credit/debit card details.
  • charge your card when your statement is due in the scenario where you have a credit account with us.

When you save your credit/debit card with us for future payments, we’re not uploading/saving anything on our servers. We send all data encrypted to Stripe and in return, we receive a token which we use for current or future payments.

If you are a customer on credit and you have agreed to charge your credit/debit card, all your statements will be cleared 3 days after the end of the month. An email notification will be sent to you 3 days prior to when the payments will occur along with the statement details. If you wish to stop a payment you need to notify us as soon as possible.

Note: if the card provided has insufficient funds and you refuse to update your payment details, penalties and late charges may apply.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchant ability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
